Since August 31, 2021, the federal Pay Equity Act has been in force for employers under federal jurisdiction with an average of 10 or more employees. Today, this law is fully part of the regulatory landscape: companies already subject to the law when it came into force had until September 3, 2024, to draw up and post their first pay equity plan. They must now ensure that pay equity is maintained through ongoing monitoring, including periodic updates every five years.
Companies that subsequently reach the 10-employee threshold will have three years following the year in which they reach an annual average of 10 employees to comply with the law and post their pay equity plan.
As of September 3, 2024, affected employers must have:
- Implemented a pay equity plan in compliance with the law.
- Posted this plan with their employees.
- The required salary adjustments applied, as of September 4, 2024, if there were any discrepancies to be corrected.
The next deadline is to file an annual declaration with the Canadian Human Rights Commission by June 30, 2025.
